PTI contests dismissal of petition against Practice and Procedure Ordinance.

ISLAMABAD – Pakistan Tehreek-e-Insaf (PTI) has filed an appeal against the dismissal of its petition challenging the Practice and Procedure Ordinance 2024.

PTI Chairman Barrister Gohar submitted the appeal, naming the President of Pakistan, the Cabinet Secretary, and the Law Secretary as respondents. The appeal urges the court to overturn the December 12, 2024, ruling, arguing that sections 2, 3, 4, and 5 of the ordinance are unconstitutional. It also seeks to nullify all actions taken under the ordinance.

Last month, the Supreme Court’s constitutional bench had dismissed PTI’s and other petitions against the ordinance. During the hearing, Justice Aminuddin Khan noted that the ordinance had already expired, while Justice Muhammad Ali Mazhar pointed out that Parliament had since legislated on the issue.

Justice Jamal Mandokhail emphasized that once a law is enacted, an ordinance automatically becomes void. He further stated that the committee formed under the ordinance had been dissolved, with its decisions now protected as past and closed transactions.
